OPEN LETTER TO METROWATER CEO: RE: Iosefa family UNLAWFUL home sale proceedings

Metrowater ‘Acting’ CEO
It is now obvious that either you have not been reading the information/ documentation that I have provided to you – or – you are continuing to rely on legal advice from those who are , in my honest and considered opinion, neither competent nor professional.
I am referring here to both ‘lawyers’ Michael Tolhurst and John Hilario.
Unlike yourself, I have made the time to go to the District Court and have obtained a FULL copy of the case file
CIV – NO 2009-004-0375, from which the High Court proceedings to sell the Iosefa family home originated.
Tim, I regret to inform you that you cannot ‘magic out of the sky’ legal documents which DO NOT EXIST.
Yesterday, I requested:
B) Can you please provide copies of the EVIDENCE, in the form of ‘Sworn Affidavits of Service’ which confirm that Luapo and Maria Iosefa of 89A Canal Road Avondale, were served with copies of the Notice of Proceedings and Statements of Claim for CIV – NO 2009-004-0375.
Your response was:
“The relevant documents should be available through the Court records however I have also asked staff to obtain copies to send through to you.”
THE RELEVANT DOCUMENTS THAT I HAVE REQUESTED ARE NOT IN THE COURT RECORDS.
Yet – you continue to state –
“Metrowater does not agree that there has been any failure in process or “unlawful action” in this case. Metrowater also does not agree with your statements that this is either “extortion” or in some way a breach of Metrowater’s “statutory duties”.
HOW CAN YOU STATE THIS WHEN YOU DO NOT HAVE COPIES OF THE COURT DOCUMENTS WHICH CAN PROVE WHAT YOU ARE SAYING????
Yet again, in my considered opinion, this confirms that you are NOT ‘fit for duty’
Please be advised that I have formally raised at the Auckland City Council meeting last night that proceedings be initiated to have you dismissed as Metrowater’s ‘Acting’ CEO.
(A copy of the fax I sent to you on 25 February 2010 was tabled at last night’s Auckland City Council meeting.)
As one of your (hopefully) last tasks as ‘Acting CEO of Metrowater, can you please arrange a meeting before Wednesday 3 March 2010 with the Chair of Metrowater’s Board of Directors, Ross Keenan, so that I can formally raise with him, further evidence of your failure to carry out your statutory duties – including your authorisiation of a complaint against me to the NZ Law Society.
You, of course are entitled to be present at that meeting, as also are Michael Tolhurst and John Hilario, whose employment by Metrowater I will be seeking to have terminated – forthwith.
